After banning smoking on screen in 2005, Indian Court changed its mind in favor of movie makers and on screen smoking is allowed.
A High Court in New Delhi judge cleared up this odd decision. Smoking ban was a restriction on creative freedom.
“The directors of films should not have multifarious authorities breathing down their necks when indulging in the creative act,” Justice Sanjay Kishan Kaul, said.
“A cinematographic film must reflect the realities of life. Smoking is a reality of life. It may be undesirable but it exists,” judge added.
Prohibition of smoking on screen was ratified in 2005. Scenes involving smoking in film and on TV were banned or distributors and broadcasters were obliged to show health warnings on older movies where such scenes existed.
Bollywood director Mahesh Bhatt appealed the law when it was enacted in 2005, calling it an absurd infringement of artistic expression.
“One would understand a ban on surrogate advertising, but to completely ban [smoking in films] is ridiculous, a joke taken too far,” Bhatt said.
Moreover, judge Kaul supports sponsorship of tobacco companies of sports events and said it cannot be a violation of the Cinematograph Act 1952.New decision may help TV and print media to resist the economic slowdown.
