The Association of National Advertisers (ANA) is a representative body for the marketing community in the United States of America. ANA’s membership includes 400 companies with 9,000 brands that together spend over one hundred billion dollars in marketing communications and advertisings.
ANA supports six major Tobacco Companies and two other industry groups in a civil appeal against the U.S. It argues that orders on tobacco advertising within the Family Smoking Prevention and Tobacco Control Act, passed earlier this year, and are unconstitutional because the limitations taken together make tobacco advertising unjustifiable.
ANA supports the intentions of the act only to protect minors from using cigarettes, but it declared that it are not agree to restrict advertising, because without ads the people’ business will degrade.
Dan Jaffe, executive vice-president (EVP) of the organization said: "This is much more than just a case about tobacco advertising. If this type of restriction is possible in tobacco, there is no question that it will be the opening step. The problem is that people are already starting to try to apply this to other products. Unstable slope is not a metaphor, it's a reality. The Supreme Court has made very clear there is not product-by-product exception. If it refers to one product category then it refers to all."
The act warrants the Food and Drug Administration to publish a rule which will prohibit outdoor advertising for tobacco products within 1,000 feet of schools and playgrounds. Also requires all tobacco advertising and direct mail to be black text on a white background, except in magazines, newspapers or other periodicals with adult readership of 85% or more, or fewer than 2 million readers under the age of 18.
To prohibit the use of promotions and promotional items holding the name or logo of a tobacco product, but plan to allow sponsorship of athletic, musical, social or other cultural events in corporate name only. And the last tobacco control act aim is to require all tobacco advertisers to invest and participate in a national educational campaign discouraging use of t smoking products by minors.
This tobacco control law will give the FDA possibility to require the annual fund prescribed for this promotional campaign to total $150 million.
